2. Acceptance of Terms
By accessing and using Chatbotty ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
3. Description of Service
Chatbotty is an AI chatbot builder platform that allows users to create intelligent chatbots from documents and web sources. The service includes multiple subscription tiers with different feature sets and usage limits.
4. User Accounts
You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password.
You must provide accurate and complete information when creating your account and keep this information updated.
5. Subscription and Payment Terms
Free Tier: Includes access to basic features with limitations on storage (10MB), chatbots (1), and messages (200 per month).
Premium Tiers: Multiple subscription options available with increased limits for storage, chatbots, and messages, plus additional features such as analytics and priority support.
Payment processing is handled by Stripe. Subscriptions automatically renew unless cancelled. You may cancel your subscription at any time through your account settings.
6. Acceptable Use
You agree not to use the service to store, transmit, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. You also agree not to interfere with the service or attempt to access accounts belonging to others.
7. Data Processing Agreement (GDPR Compliance)
Your privacy is important to us. Please review our Privacy Policy, which also governs your use of the service, to understand our practices regarding the collection and use of your information.

8. Service Level Agreement (SLA)
Service Availability
- • Uptime Guarantee: 99.5% monthly uptime for premium users, 99.0% for free users

- • Emergency Maintenance: May occur without notice for security issues
Support Response Times
- • Premium Users: 24 hours for general issues, 4 hours for critical issues
- • Free Users: 72 hours for general issues, best effort for critical issues
- • Critical Issues: Service unavailable, data loss, security breaches
Service Credits
If we fail to meet our uptime guarantee, premium users may be eligible for service credits:
• Below 99.5%: 5% credit • Below 99.0%: 10% credit • Below 95.0%: 25% credit
9. Refund Policy
We offer refunds under the following conditions:
- • 30-Day Money-Back Guarantee: Full refund available within 30 days of initial purchase
- • Service Failure: Refund available if service is unavailable for more than 48 consecutive hours
- • Billing Errors: Immediate refund for incorrect charges
- • Refund Processing: Refunds processed within 5-10 business days to original payment method
- • Partial Refunds: Pro-rated refunds available for mid-cycle cancellations

10. Data Retention and Deletion
Data Retention Periods
- • Account Data: Duration of service + 3 years for legal compliance
- • Chatbot & Document Content: Until account deletion or manual deletion by user
- • Usage Analytics: 26 months for service improvement
- • Payment Data: 7 years for tax and legal requirements
- • Support Communications: 3 years from last interaction
Data Deletion
- • Account Deletion: Complete data removal within 30 days of request
- • Backup Deletion: Backup data removed within 90 days
- • Legal Holds: Some data may be retained longer for legal proceedings
- • Anonymization: Some data may be anonymized for statistical purposes
11. Security Breach Response
In the event of a security breach involving personal data, we will:
Immediate Response (Within 72 Hours)
- • Contain and assess the breach
- • Notify supervisory authorities (where required by GDPR)
- • Begin internal investigation
- • Implement additional security measures
User Notification
If the breach poses a high risk to your rights and freedoms, we will notify affected users without undue delay, providing information about the breach and recommended actions.
12. Age Restrictions and Eligibility
Minimum Age: You must be at least 16 years old to use this service (13 years in the US with parental consent).
Parental Consent: Users under 18 must have parental or guardian consent to use the service.
Business Users: Business accounts require the user to have authority to bind the organization.
13. Export Controls and Restrictions
The service may be subject to export control laws and regulations. You agree not to use the service in countries subject to trade embargoes or sanctions.

In no event shall Chatbotty be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the service.
17. Termination
We may terminate or suspend your account and bar access to the service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.
18. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
