2. Acceptance of Terms

By accessing and using Chatbotty ("the Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.

3. Description of Service

Chatbotty is an AI-powered chatbot builder platform that allows users to create intelligent chatbots from documents and web sources. The service includes multiple subscription tiers with different feature sets and usage limits. Chatbot responses are generated using third-party AI language models.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your account. You agree to accept responsibility for all activities that occur under your account.

You must provide accurate and complete information when creating your account and keep this information updated.

5. Subscription and Payment Terms

Free Tier: Includes access to basic features with limitations on storage (10 MB), chatbots (1), and messages (200 per month).

Premium Tiers: Multiple subscription options with increased limits for storage, chatbots, and messages, plus additional features such as analytics and priority support.

Payment processing is handled by Polar (polar.sh), which acts as the Merchant of Record for all transactions. Polar collects and remits applicable sales taxes and VAT on our behalf for international purchases. By making a purchase, you also agree to Polar's Terms of Service.

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings; access continues until the end of the paid period. One-time add-on purchases (additional message requests) are non-refundable once consumed.

6. User Content and Intellectual Property

Your Content:You retain full ownership of all documents, data, and other content you upload to the service ("User Content"). By uploading content, you grant Chatbotty a limited, non-exclusive license to process and store that content solely for the purpose of providing the service to you.

Chatbot Output: Content generated by your chatbots in response to end-user queries belongs to you, subject to the terms of the underlying AI model providers (currently OpenAI).

Our Platform: The Chatbotty platform, including its design, features, and functionality, is owned by Puretech s.r.o. and protected by applicable intellectual property laws. You may not copy, modify, or redistribute any part of the platform without our prior written consent.

Responsibility for Content: You are solely responsible for ensuring that any content you upload does not infringe third-party rights (copyright, personal data, confidentiality) and complies with applicable laws.

7. Acceptable Use

You agree not to use the service to store, transmit, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. You also agree not to interfere with the service, attempt to access accounts belonging to others, reverse-engineer any part of the platform, or use the service to train competing AI models.

8. AI Service Disclaimer

Chatbotty uses third-party AI language models (currently OpenAI) to generate chatbot responses. Please be aware of the following limitations:

  • Accuracy: AI-generated responses may be inaccurate, incomplete, or outdated. Always verify important information from authoritative sources.
  • No professional advice: Chatbot responses do not constitute legal, medical, financial, or other professional advice.
  • Model changes: We may update or switch the underlying AI models at any time to improve the service.
  • Third-party terms: Use of AI features is also subject to OpenAI's usage policies.

9. Data Processing and GDPR

Your privacy is important to us. Please also review our Privacy Policy, which governs the collection and use of your personal information.

Data Processing Details

  • Legal Basis: Contract performance (Article 6(1)(b) GDPR) and legitimate interests (Article 6(1)(f) GDPR)
  • Data Categories: Account information, chatbot content, document uploads, usage analytics, payment data
  • Processing Purposes: Service provision, account management, chatbot functionality, analytics, billing, customer support
  • Data Retention: Account data retained for duration of service + 3 years; payment data per legal requirements
  • International Transfers: Some data is processed in the United States by our sub-processors (including OpenAI, Vercel, and Upstash). These transfers are governed by Standard Contractual Clauses (SCCs) or the EU-US Data Privacy Framework where applicable.

Data Security

10. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. The service depends on third-party infrastructure providers (Vercel, Supabase, Upstash) whose availability is outside our direct control.

Maintenance

  • Planned Maintenance: Scheduled during low-usage periods with at least 24-hour advance notice where possible
  • Emergency Maintenance: May occur without notice to address security vulnerabilities or critical failures

Support Response Times

  • Premium Users: Best effort within 24 hours for general issues
  • Free Users: Best effort within 72 hours

11. Refund Policy

  • 30-Day Money-Back Guarantee: If you are not satisfied with your first paid subscription, you may request a full refund within 30 days of the initial purchase by contacting support@chatbotty.ai.
  • Billing Errors: We will refund any verifiable billing errors promptly.
  • Cancellation: Cancelling a subscription stops future renewals; no refund is issued for the remaining portion of a paid billing period.
  • Add-ons: One-time purchases (e.g., additional message requests) are non-refundable once consumed.
  • Refund Processing: Approved refunds are processed by Polar within 5–10 business days to the original payment method.

12. Data Retention and Deletion

Retention Periods

  • Account Data: Duration of service + 3 years for legal compliance
  • Chatbot & Document Content: Until account deletion or manual deletion by user
  • Usage Analytics: 26 months
  • Payment Records: 7 years for tax and legal requirements
  • Support Communications: 3 years from last interaction

Account Deletion

  • • Personal data and chatbot content removed within 30 days of account deletion request
  • • Backup copies removed within 90 days
  • • Payment records and legally required data retained per applicable retention periods above
  • • Some data may be anonymized and retained for statistical purposes

13. Security Breach Response

In the event of a personal data breach, we will:

  • • Contain and assess the breach as quickly as possible
  • • Notify the relevant supervisory authority within 72 hours where required by GDPR
  • • Notify affected users without undue delay if the breach poses a high risk to their rights and freedoms
  • • Implement corrective measures to prevent recurrence

14. Age Restrictions

You must be at least 16 years old to use this service, in accordance with GDPR requirements for digital services in the EU. By using the service, you confirm that you meet this age requirement.

Business Users: If you are using the service on behalf of an organization, you confirm that you have the authority to bind that organization to these terms.

15. Limitation of Liability

To the maximum extent permitted by applicable law, Chatbotty shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the service.

Our total liability to you for any claim arising from these terms or the service shall not exceed the amount you paid to us in the 12 months preceding the claim, or €100, whichever is greater.

Nothing in these terms limits liability that cannot be excluded under applicable law, including liability for fraud or death/personal injury caused by negligence.

16. Termination

We may suspend or terminate your account if you materially breach these terms, with notice where reasonably practicable. You may terminate your account at any time through your account settings or by contacting support@chatbotty.ai.

Upon termination, your access to the service ends immediately. Your data will be handled in accordance with Section 12 (Data Retention and Deletion).

17. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Czech Republic, without regard to conflict of law principles. Any disputes arising from or relating to these terms or the service shall be subject to the exclusive jurisdiction of the courts of the Czech Republic. If you are a consumer resident in the EU, you may also benefit from any mandatory protective provisions of the law of your country of residence.

18. Changes to Terms

We reserve the right to modify these Terms at any time. For material changes, we will provide at least 30 days' notice by email or a prominent notice within the service before the new terms take effect. Your continued use of the service after the effective date constitutes acceptance of the updated terms.
